Awaiting jail, Lohan wins ‘milkaholic’ lawsuit
Victory comes on eve of court hearing where she is likely to be sent back to jail
Actress Lindsay Lohan, awaiting a hearing on Friday when she is likely to be sent back to jail for failing two court-ordered drugs tests, received some good news last night. Her $100m lawsuit against E-Trade has been settled. Although she is thought to have received nothing like the $100m damages she was seeking, it is understood there was a cash settlement.
Lohan had sued E-Trade over a TV commercial in which a baby called Lindsay was called a "milkaholic". Her lawyers argued that the ad violated her rights. Her public profile was such that the advertiser clearly intended to exploit her reputation. 'Lindsay' had the standalone status of Madonna or Oprah.
Lohan's case was helped when Esquire magazine discovered the milk-drinking baby's name had been changed from Deborah to Lindsay.
The terms of the settlement have not been released but a spokesman for E-Trade said it "was a business decision to move on". A spokesman for Lohan said she was "very happy" with the result of the case.
Lohan is due to face Judge Elden S. Fox in Beverly Hills on Friday to explain why she broke the terms of her probation following her release from jail last month after serving only 13 days of a 90-day term.
The jail sentence had been imposed for a probation violation dating back to two 2007 drink driving charges.
As part of her early release arrangement, the Mean Girls actress had to submit to random drug and alcohol testing. She duly failed two of these tests - for cocaine and amphetamines.
Facing a possible 60 days back in jail, Lohan wrote on Twitter this week: "I am taking responsibility for my actions and I'm prepared to face the consequences." Her mother, Dina, said: "Addiction is difficult."
