Judge allows Sheen and his wife to be together again - but assault charges remain

Charlie Sheen, star of the hit TV comedy Two And A Half Men, kissed and hugged his wife Brooke Mueller after they left court in Aspen, Colorado yesterday on went home together to Los Angeles. But the 44-year-old actor still faces serious charges of assaulting and threatening her with a knife on Christmas Day, which carry a potential three-year-jail sentence.

At the request of both parties, the judge yesterday lifted the "no contact" element of a restraining order that has kept the couple apart since Christmas. But he made it clear he was only loosening the order on condition that Sheen, one of the highest-paid TV stars in the US, did not drink alcohol, carry a gun or harass his wife.

According to a court affidavit, the actor had been arguing with Mueller, his third wife, early on Christmas morning when she threatened to divorce him and take their twin boys. As a result, he is alleged to have pinned her to a bed and held a knife to her throat.
 
As Sheen and Mueller left Aspen for Los Angeles on Monday, her lawyer told reporters: "I can tell you, Brooke very badly wanted to have contact with Charlie. There are many children's issues that she wanted to communicate with him about. They have two gorgeous beautiful babies together."

He also said: "Brooke would like this case to be over and charges dismissed so they can get on with their lives."

However, that is not to be. Prosecutors are intent on pursuing the charges against the eldest son of West Wing 'president' Martin Sheen, which include menacing his wife with a knife, second-degree assault and criminal mischief.

The news that prosecutors are refusing to drop the charges is more bad news for Sheen: the Los Angeles Times reported on Saturday that thieves stole a Mercedes from the garage of Sheen's Los Angeles home and then drove it into a ravine off Mulholland Drive, where it was discovered overturned and badly damaged. ·
